3 MAJOR TYPES OF TITLE DEEDS

A title deed is a legal document that signifies the Rightful ownership of a Land. It captures the Details of the Property Owner, location, Size, and Dimensions. A title deed at some point has a Registrar’s Seal and Signature which affirms it’s genuine. However, in a Land without own ready Genuine Title Deed, your ownership may be meaningless. It’s one of the most important documents one should have after acquiring a Land.

Also, before you buy land, ensure that you’ve conducted detailed research on the particular piece of property that you intend to buy.

Below are three major title deeds in Kenya;

  1. Absolute Title Deed

It’s also known as the Freehold Title Deed. With this type of a Title Deed you are not limited in any way. In this case, the Rightful Landowner is in full control of the land without any kind of restrictions or period of ownership.

Having this Absolute type of a Title Deed one can further subdivide the land and get Individual Title Deed for each piece of land. In short one has maximum rights to the land. It’s easily to leave an inheritance to Generations with this type of Title Deed.

  1. Lease Title

Also known as Certificate of Lease. Have you ever heard of Land Rates? Most of the lands subjected to these annual payments (Land Rates) falls in this Category of Title Deed.

The occupant of the Land is called the Lessee and the Landowner is the Lessor. This type of Title Deed states that one owns the land with restrictions and indicated period of which it’s maximum is 99 Years. After the period given to the occupant is over, they are required to Renew to ownership and at this point the Lessor can decide to reclaim back the land.

  1. Sectional Title Deeds

This mainly applies where one owns a house in an apartment or flat. The rate at which people are going for this option is very high having accelerated by the scarcity of lands in urban areas and also the high cost of commodities thus giving opportunities to go for cheaper options.

It’s the easiest way when it comes to housing baring in mind that one will live in a house without necessary thinking about Rent payments every now and then.

After the purchase, that’s when the very people are presented with a sectional title deed that now confirms ownership of that property.
